Who gets this? Shops on all Postscript plans have access to this feature. Learn more about Postscript Plans.
Postscript’s Dynamic Terms of Service (DToS) and Messaging Privacy Policy are hosted messaging compliance documents that are maintained by Postscript as TCPA case law, carrier requirements, and state telemarketing rules evolve.
By linking directly to these hosted documents from your SMS consent collection points – including popups, checkout pages, and landing pages – your messaging program stays current without requiring ongoing manual updates from your team.
Why use Dynamic Terms of Service and Messaging Privacy Policy?
Dynamic Terms of Service and Messaging Privacy Policy are designed to help support your SMS program by enabling you to:
Stay up to date as carrier requirements, TCPA guidance, and messaging regulations evolve. Once enabled, your Messaging Terms and Privacy Policy are maintained and updated by Postscript.
Help strengthen your defense against common SMS litigation patterns, including quiet-hours claims, opt-out evader claims, and internal Do-Not-Call policy claims.
Access Postscript’s arbitration arrangement with New Era ADR, designed to help keep costs lower if subscriber disputes arise.
Spend less time managing messaging compliance updates and more time focused on growing your SMS program.
Edit Fields in Your Terms and Privacy Policy
Start by editing the fields within your Shop Settings that populate your Dynamic Terms of Service and Messaging Privacy Policy. These fields are pre-populated using your Shopify store information by default.
From your Postscript Dashboard, select your shop name on the left-side navigation panel.
Under your Shop Settings, select the Compliance tab.
Under Billing address, you can edit your shop's billing address details.
Save by selecting the Save Changes button.
Update your Dynamic Terms and Privacy Policy at SMS Consent Collection Points
To use Dynamic Terms of Service and Messaging Privacy Policy correctly, make sure your SMS consent collection points are presenting the hosted Dynamic Terms of Service and Messaging Privacy Policy directly to subscribers at the time consent is collected.
For any Postscript-hosted opt-in method, we manage this for you.
This includes:
Popups
Landing pages
Checkout opt-in sections
Embedded sign-up forms
Other SMS consent collection experiences
This step is especially important for merchants using custom or third-party popup experiences where consent language and terms links are managed manually.
Postscript Opt-In Methods
All non-legacy Postscript opt-in methods automatically use your hosted Dynamic Terms of Service and Messaging Privacy Policy once configured. Support for additional opt-in experiences, including Alia Onsite Opt-In popups, is also being expanded over time.
Configure Dynamic Terms and Privacy Policy in Shopify
During onboarding, you were prompted to copy and paste the dynamic links into your Shopify Terms of Service and Privacy Policy sections. This cross-linking is helpful to consumers, but is not a substitute for ensuring that each of the opt-in points link directly to the Dynamic Terms of Service and Messaging Privacy Policy as discussed in the previous step.
Notify Subscribers of Changes to Your Terms or Privacy Policy
As the SMS landscape changes, Postscript will notify you of updates and automatically refresh your Dynamic Terms of Service and Messaging Privacy Policy so you stay compliant and reduce risk.
To increase the ability to apply updated terms to your existing subscriber base, we recommend notifying subscribers when changes are made. You can:
Send your list an SMS campaign that includes a link to your updated messaging terms or updated messaging privacy policy.
Add a banner on your website with a link to your Terms or Privacy Policy.
Email your subscriber base with a link to your updated terms or privacy policy.
Notifying customers of changes to your Terms or Privacy Policy protects your business while promoting trust and transparency with subscribers.
Prefer to maintain your own terms?
We strongly recommend using our dynamic hosted links to keep your terms up-to-date. If you choose not to, you can maintain your own messaging terms and privacy policy manually.
Please note that merchants maintaining their own messaging terms and privacy policy are responsible for keeping those documents updated as messaging regulations and carrier requirements evolve.
To do so, during onboarding:
Click the dropdown next to "I prefer to manage my own messaging terms and privacy policy."
Review the compliance acknowledgment
Select the checkbox confirming that you agree to coordinate with the Postscript compliance team to establish and maintain messaging Terms of Service and Privacy Policy that align with industry standards, Postscript Terms, and carrier requirements
