Compliance Update: Texas Messaging

Effective September 1, 2025, the state of Texas (TX) introduced new compliance regulations (Texas SB 140) in addition to nationwide federal TCPA regulations and industry standards required by cellular carriers.

These legislative changes were mistakenly interpreted by others in the industry to affect all brands with subscribers in Texas, regardless of SMS platform. However, as of September 26, 2025, the Texas Attorney General has agreed with Postscript that SB 140 does not apply to Postscript customers who send messages with prior consent.

That means Postscript customers are not required to register, post bonds, or follow Texas “quiet hours” rules in order to stay compliant.

What Are The Key Changes?


Texas has  shorter “waking hours” for Texas residents, but these waking hours do not apply to messages sent with prior consent:

  • 9:00 AM to 9:00 PM local time, Monday–Saturday
  • 12:00 PM to 9:00 PM local time on Sundays

While this feature is not legally required, to give merchants flexibility, Postscript rolled out an Optional Texas Quiet Hours feature. When turned on, Postscript will automatically limit sends to Texas area codes within these timeframes.

How Postscript Handles Quiet Hours


If you choose to turn on Optional Texas Quiet Hours, here’s how it works:

  • Postscript screens subscribers by area code to identify Texas residents and prevents messages from going to Texas numbers during quiet hours.
  • Messages in campaigns, automations, and flows scheduled during quiet hours will automatically be held until Texas waking hours resume (9:00 AM or noon on Sundays).
  • Legacy campaigns scheduled during quiet hours will exclude Texas numbers automatically. You won’t be charged for unsent messages.
  • No extra action is needed for individual campaigns or flows. This is applied globally when the setting is activated.

Turning Texas Quiet Hours On or Off


By default, this setting is turned off That means Postscript does not block messages to Texas subscribers during quiet hours unless you explicitly activate it.

  • When off: Messages follow your regular campaign and automation schedule.
  • When on: Messages to Texas subscribers will only be delivered between 9 AM–9 PM Monday–Saturday and 12 PM–9 PM Sundays (Texas local time).

  1. From the Postscript Dashboard, select your shop from the left-hand menu.
  2. Under Settings, select Compliance.
  3. Scroll to Optional Texas Quiet Hours and toggle Enforce Texas quiet hours on or off.
